Giving a preference for a setting with an EHC Plan

If a child or young person has an EHC Plan you have a legal right to request that a particular setting is named in Section I. This includes a preference for an independent school, college or other institution.

Overview

If a child or young person has an EHC Plan you have a legal right to request that a particular setting is named in Section I. This includes a preference for an independent school, college or other institution.

You might request a particular school or college when

  • the child or young person is getting an EHC plan for the first time
  • if the EHC plan is being amended after an annual review
  • if the EHC plan is being amended at any other time. For example, if the child or young person has to move setting.

You make the request to the SEN Team.

School admissions cannot process a request for another setting while an EHC Plan is being drafted or is in place.
